A woman has been convicted for filing a false rape case against two persons 15 years ago. The Supreme Court found Mahila Vinod Kumar guilty of perjury (misleading the court with false evidence) and refused to accept her defence that she was illiterate.
Justice Arijit Pasayat and Justice P Sathasivam ruled: “Courts should strive harder to tackle the evil of perjury. It has assumed alarming proportions in cases depending on oral evidence and in order to deal with the menace effectively, it is desirable for the courts to use the provision more effectively and frequently.”
Upholding the judgement of the Madhya Pradesh High Court that convicted the woman for three months, the Bench empathised with the two men, saying they had to “face the ignominy of a trial for a serious offence like rape”. “Their acquittal may, to a certain extent, have washed away the stigma, but that is not enough,” the judges added.
Mahila had in January 1993 lodged a rape case, claiming the two men sexually assaulted her. On the basis of her complaint, the accused were arrested and faced the trial.
The complainant, however, retracted during her cross-examination and denied making the charges against the two. She also denied having registered the FIR against them.
The trial court acquitted the men but initiated perjury proceedings and convicted her to three months imprisonment.

A former nightclub manager claims his life has been ruined after he was falsely accused of rape.
Raymond Chan, 43, walked free from Lewes Crown Court after he was cleared of the sex attack by a jury. But he said his life would never be the same.
The father-of-four said he had lost his job, many of his friends, the business reputation he had spent years building and his family home in Ireland.
He said: "My life has been ruined. This has crippled me."
Mr Chan, former manager of The Gloucester nightclub in Brighton, spent seven months in custody after being charged with raping a 33-year-old nurse at a flat in the city in January last year.
The woman claimed she woke up after a drunken night out to find a stranger having sex with her. She told the jury she had no idea where she was or who the man was.
The prosecution accused Mr Chan of taking advantage of the woman, who, they said, was incapable of giving consent because she was so intoxicated.
But Mr Chan said she had sex with him willingly and had not behaved like she was drunk.
After a week-long trial the jury took less than 30 minutes to return a unanimous not guilty verdict.
Mr Chan said he broke down in the dock as the verdict was announced.
He said: "At first it didn't sink in. I choked. I got tearful. It was such a relief it was all over.
"I was actually afraid to walk out of the court on to the steps because I kept thinking somebody was going to stop me from leaving."
The court heard how the woman left a party in the early hours of the morning to return to her Brighton flat without taking her bag, purse, phone or door keys.
Mr Chan was driving by her flat when he saw her outside and offered to help. They drove back to his flat at the Gourmet Palace restaurant in St James's Street, where he was manager at the time, so she could contact a locksmith.
He said once they arrived they watched a DVD on the sofa and then began kissing. He said she willingly had sex with him twice before he called a taxi at about 6am to take her to a friend's house.
He said as far as he was concerned, it was a one-night stand and she was happy to have sex with him. He said: "I thought we had a fun night."
She later called the police claiming she had been raped.
Mr Chan was remanded in custody in March this year and sent to Lewes Prison. He said he had a hard time in jail and reluctantly agreed to go on the vulnerable prisoner wing after other inmates found out he had been charged with rape and threatened him.
He said: "When you are in prison you don't think about the other side of the wall because it will do your head in.
I was always confident that one day I would be cleared because I was innocent."
He believes what saved him from spending years in jail was CCTV footage of the inside of the restaurant, which showed the woman freely walking around.
He said: "The CCTV saved me. Without that I would still be behind bars."
Mr Chan, who was born in Malaysia and has lived in Brighton since 1974, believes the law should be changed so people accused of rape have the same anonymity as their accusers until conviction.
He said: "The effect on my family has hurt me more than spending time in prison.
The jury cannot take back that time.
"I've had it easy in prison compared to my family.
"I have been tainted and there is no two ways about it.
Even though I have been vindicated by the jury, because of the type of crime, people will always wonder.
"My nightmare is not over yet."

Taxi driver Clive Bishop, from Street, is still coming to terms with events following a night in February last year when Kirsty Palmer, of Pilton, made the drunken allegation to police.
Months later - and in the face of a mountain of evidence against her - Palmer finally admitted to police she had made up the whole story.
Last month Palmer, a mother of two, was jailed for 10 months for perverting the course of justice, but the effects of the case have taken their toll on Mr Bishop and wife Sue.
Mrs Bishop said: "When the police arrived here I immediately thought the worst, that something had happened to one of Clive's kids.
"When they said we are arresting you on suspicion of rape I actually thought 'thank god for that'. I never doubted him for a moment and we have stood together in all of this."
Mr Bishop was taken away for questioning and had to suffer a thorough examination.
"I just felt livid that someone's stupid, drunken allegation was leaving me like this," he said.
A dossier of information that Mr Bishop put together himself, with proof of where he was on that night thanks to CCTV and mobile telephone calls, finally proved the rape claim was false.
But Mr Bishop's hell was to continue for more than a year as they kept their nightmare secret.
He said: "Over the years we have helped teenagers exactly like this young, troubled woman. It has been terribly rewarding to see how young teens exactly like this woman turned around. For this to happen to us is ironic."
Eventually the strain was too much on Mr Bishop and he sought help from his GP, undergoing counselling.
"The stress of having to live a lie for months and months has been unbearable."
Following the verdict, they went to their families and friends and told them the story.
"Everyone's support has been just fantastic.
"I went back out as a taxi-driver for one night, but was so anxious that something like this could happen again that I made the decision to get rid of the car and give up cab-driving."
Because there was no physical assault, the Bishops have been told they cannot claim compensation from the Criminal Injuries Board.
Mr Bishop is pursuing civil action against Palmer and met MP David Heathcoat-Amory as part of his campaign for what he calls real justice.
"I hope other people learn from this. I was lucky that I could prove my case, other people might not be able to," he said.

A teenage girl whose "wicked" allegation of rape nearly ruined the life of a Street taxi driver has been sent to a young offenders institution for 10 months.
Clive Bishop said he felt his "world was falling apart" when police arrived at his home on February 25 last year and arrested him for rape in front of his wife.

Mr Bishop was able to prove his innocence and Palmer later admitted a charge of perverting the course of justice.

“I thought 'how am I going to be seen by other people?' I've never been in trouble with the police.
“It affects how I interact with people now, I worry about how they perceive me. It's made me a bit shy.”
Jerome was pulled aside by police as he went into college, and was arrested on suspicion of the attack on a female student last October.
The business diploma student says he was cleared after DNA tests ruled him out and because the woman who reported the crime failed to identify him as her attacker.
But the South Croydon resident added: “I started wondering if I could be in the one per cent of people who get put away on false charges.
“Imagine if I did go away for 10 or 15 years, and I got out and that's all people thought about me.”
Jerome accepts police have to investigate crimes but believes they did not have to arrest him for rape as he would have co-operated with inquiries.
And he does not understand why he had to be kept in a cell overnight when he hadn't even been charged.
“The cell was like insanity,” he said. “You are in a box, you cannot connect with other people.
“You hear other people in cells down from you, shouting to be let out. You can't go to the toilet without being watched on camera.
“It's very daunting to know every aspect of your privacy is taken away from you.”
Jerome was told the alleged rape had taken place in the college basement – where the gym is located.
He believes he was spotted going to the gym around the time the attack is said to have happened
He thinks he was arrested because he matched the description of the attacker which was given by the victim.
But he believes the balance of justice needs to be fairer on the accused until proven guilty.
“People need to be a bit more aware and listen to both sides,” he said. “We always get the victim's view but not the accused's who could be innocent.”
A spokeswoman for Croydon police confirmed that Jerome had been eliminated from inquiries.

Zoe Turner met the man she accused of raping her in a Bristol club and ended up sleeping with him in his hotel bed.
A recorder at Bristol Crown Court heard that nothing sexual took place between the two but when the woman's furious boyfriend found them she told police she had been raped.
The 33-year-old mother-of-five, of Nags Head Hill, St George, retracted the allegation two days after and later admitted a charge of attempting to pervert the course of justice.
She was given a four-month prison sentence, suspended for two years, and was ordered to do 100 hours of unpaid work in the community.
Simon Goodman, prosecuting at Bristol Crown Court, said Turner met the complainant, who cannot be identified on the direction of the recorder, at the Chicago Rock Cafe in Bristol on November 19 last year.
The two met again the following night and Turner ended up staying the night in the man's hotel room.
The court heard how Turner's boyfriend came in the next morning and there was a row.
Mr Goodman said the defendant made a false rape allegation to police later that morning.
But on November 22, after being asked to make a filmed police interview, Turner withdrew her allegation.
Mr Goodman said: “A lot of police time was spent on the investigation. Although he was not arrested, he was at risk of it.
“She retracted within two days of the complaint. The reason she didn't go through with the video is because she didn't want it to go too far.”
Robin Shellard, for Turner, said his client pleaded guilty in March this year despite knowing she risked being jailed. He said she realised what she did was “very, very, wrong”.
Recorder Mr Llewelyn Sellick told Turner that he had to pass a prison sentence.
“What you did is falsely accuse a man who had done you no harm at all of a very serious sexual offence,” he said.
“There was a comparatively long period when the man was at risk of being arrested. You told lie, after lie, after lie.
“In December you were still telling lies, saying something must have happened.
“You actually went to a hotel with the man. When you were confronted with that you admitted what you had done.
“There has to be a prison sentence. I'm able to suspend that,” he said.

It is the fiercest and most fearless defence of men, fatherhood and ultimately the family I have read in many years.
American author Kathleen Parker's courageous thesis is that initially, through extreme feminism, then via its craven implementation into society, women have demonised men and trivialised their contribution, especially to family life.
I say courageous because, in the eyes of many women and of the liberal establishment, suggesting men have had a rough deal is nothing short of heresy.
Parker should be burnt at the stake, they cry. But isn't it ironic that only a woman could make such a plea for men?
She argues: 'As long as men feel marginalised by the women whose favour and approval they seek, as long as they are alienated from their children and treated as criminals by family courts, as long as they are disrespected by a culture that no longer values masculinity tied to honour, as long as boys are bereft of strong fathers and our young men and women wage sexual war, then we risk cultural suicide.'
It's enough to set a feminist's hair on end. Parker argues that in trying to make the world fairer for women, an adjustment most agree was vital, we have made it unfair for men. In our attempt to honour women, we have dishonoured men.
By bending over backwards to make single mothers feel good about themselves, by diminishing the role of fathers, by elevating women as the superior parents, we have gone a considerable way to destroying one of the basic tenets of a successful society - family life.
Apart from the effects of this seismic social shift on society, it is also grossly unfair. Can you imagine a world where men demanded women be more like them - dress like them, act like them, even look like them. Because that is effectively what our post-feminist society has done, but with the genders switched.
The traditional male values, what Parker almost poetically calls 'masculinity tied to honour', are now seen as nothing more than a direct assault on women.
Unless men are like us, the thinking goes, they insult us and threaten our existence: hence the feminisation of men, or as we so disingenuously describe it, getting in touch with your feminine side.
Thus Hybrid Man was born. An acceptable male model now is more likely to be of the David Beckham variety, wearing more make-up than the missus, hairless, perfumed, varnished, emasculated by his bossy wife and perhaps fond of wearing her undies.
Good dads, loving husbands, supportive male role models, they're few and far between even in the fictional world of TV.
But in the real world it wasn't enough that we demanded they be more like us, we superior human beings. We had to traduce men as well, treating them in almost all forms of popular culture as useless, ineffectual, even comic characters, or as violent, cheating and untrustworthy.
And so Sitcom Man was born. Parker challenges us to try to think of a wholesome, reliable role model in myriad 'dads' created on TV or in movies. Fathers are always portrayed as incompetent or inconsequential, mindless or mean, comic or cruel. If you relentlessly portrayed any ethnic or minority group in such a biased way, you'd be pilloried on air.
Parker cites many reasons for the dereliction of men. First, there has been the institutionalisation of motherhood at the expense of fatherhood.
'We seem to accept that children shouldn't be raised without mothers, but we regard the contributions of fathers as optional,' Parker says.
Just last week, Nicola Brewer, the chief executive of the Equality and Human Rights Commission, said: 'Fathers are being marginalised to the extent of simply "seasoning" in their children's upbringing.'
And the state reinforces the 'Mum best, Dad dodgy' myth. 'The family courts effectively make fathers a slave to the state, his wages become state property, his time with his children is determined by a family court judge, and he faces jail if for whatever reason he fails to pay his child support on time.'

A Hall County man owes his ex-fiancee $150,000 for breaking off their engagement, a jury decided Wednesday.
The six-man, six-woman panel spent about three hours deliberating before ruling in favor of RoseMary Shell, who sued Wayne Gibbs for breach of contract after he called off their nuptials.
"I’m thrilled, needless to say," a beaming Shell said after the verdict. She referred all other questions to her attorney, Lydia Sartain.
Gibbs and his attorney, Hammond Law, both declined to comment on the verdict.
Law had earlier argued that a verdict in favor of the plaintiff would send the wrong message to the community.
"You would be sending the message that if you have a dispute with somebody and you think they have been a scoundrel, go get a lawyer and hope the Brinks truck backs up to the jury room," Law said during his closing argument to the jury. "If you award one penny, you’re saying, ‘file frivolous lawsuits.’ "
The jury award was "significantly higher" than an amount Shell said she would accept during pre-trial settlement discussions, Sartain said.
"We’re certainly pleased with the verdict of the jury and very satisfied with the amount awarded," Sartain said. "Obviously they took this case very seriously and understood that Mr. Gibbs had without justification breached a contract and caused my client a great deal of harm, financially and emotionally."
During the three-day trial, Shell testified that she quit a job paying $81,000 a year in Pensacola, Fla., to move back to Gainesville and be with Gibbs after he proposed in October 2006. In December he left a note in the couple’s bathroom expressing second thoughts about the marriage, and he broke off the engagement for good in March 2007. Shell, who now makes $31,000 a year working for North Georgia College & State University, sued the following June.
Juror Delita Smith said after the trial that the jury decided on the amount by calculating one year of Shell’s old salary working as a human resources manager at a newspaper company in Pensacola, counting a 15 percent annual bonus and benefits valued at up to $40,000.
Smith said deliberations were "really, really hard."
"She should have stayed in Florida," Smith said. "I would, if I had that high-paying job. But if he didn’t want to marry her, he shouldn’t have given her the ring. At some point, I think he misled her in a way."
Smith said she was "really shocked" that a broken wedding engagement would end up in court.
Sartain maintained that contract suits for withdrawn marriage proposals are not unusual.
"These cases are tried throughout the United States," Sartain said, though she said they were "not (tried) with great frequency."
Law said earlier this week that he could find only one prior instance of someone suing over a broken wedding engagement in a search of 25 years of Georgia case histories.
Judge Kathlene Gosselin instructed the panel during her jury charge that "breach of promise to marry is a common law contract action."
"By the very nature of the action, there must be an actual promise to marry and acceptance of that promise before one can be held liable for a breach," the judge told the jury.
Sartain told the jury in her closing argument that they should find Gibbs responsible for Shell’s financial and emotional suffering
"If you make an agreement with someone, if you cause them to rely on that agreement to their detriment, you’re responsible," Sartain said.

One of the worst injustices modern fathers face is false allegations of molestation used by mothers as part of custody battles. Courts usually "err on the side of caution," and falsely accused fathers usually must fight a long, hard battle in order to clear themselves and get back into their children's lives. Mothers who make these allegations are playing a game they rarely lose -- if they can make the false allegation stick, they win child custody. If they can't, they still usually keep child custody or at worst have joint custody.
That's why it was gratifying to see the story below, where the Connecticut Supreme Court upheld a lower court decision that a mother must pay her child's father $3.5 million in damages for falsely accusing him of sexually abusing their daughter.
The couple had joint custody of the five-year-old-girl when the mother made the allegations.
I do want to criticize the father's comments below on one point. The father seems to be convinced that part of the reason why the allegations ruined his life is race. He is an immigrant from India, and he believes the American courts sided with the mother because she is white.
While I have no doubt that people from India suffer racism in the United States, I think the father is wrong on this one. All other factors being equal, white fathers generally get treated just as badly in these false allegations cases as nonwhite fathers. As I once said in a speech I made at a father's rights rally here in Los Angeles, "Family Court is one place where race doesn't matter -- white, black, Latino, Asian, it makes no difference -- fathers of all races are treated like second-class citizens." The mother did not receive preferential treatment because she is white as much as she received preferential treatment because she is the mother.

The Connecticut Supreme Court has upheld a superior court’s decision that a mother must pay her ex-fiancé $3.5 million in damages for allegedly falsely accusing him of sexually abusing their daughter. But the girl’s mother says she still believes her former lover is the guilty one.
In the June 24 decision, the court affirmed that Marlene Debek must pay Ajai Bhatia $3,544,500 in damages, including $2.5 million for emotional distress, loss of reputation and humiliation; $500,000 for loss of income; $540,000 for attorney’s fees; and $4,500 for his bail bond premium.
The case goes back to 2001, when Bhatia and Marlene Debek had joint custody of their daughter, who was then 5 years old. THE lesbian mothers of IVF twin girls have lost a legal bid to sue their doctor for the cost of raising one of the toddlers.
The women, whose names have been suppressed, sued prominent Canberra obstetrician
Sydney Robert Armellin for more than $400,000 for implanting two embryos instead of the requested one.
The ACT Supreme Court today ruled in favour of Dr Armellin, and ordered the couple pay his legal costs.
The IVF procedure, which used sperm from a Danish donor, resulted in the birth of twin girls, now aged four.
The couple, whose combined income is more than $100,000, sought $398,000 from Dr Armellin to cover the costs of raising one of the girls, including fees for a private Steiner school in Melbourne.
The court was told the twins' birth mother had lost her capacity to love and the couple's relationship suffered as they became mired in everyday tasks associated with raising two children.
But Dr Armellin's lawyer said loss of freedom was experienced commonly by parents across Australia.
The couple said it was Dr Armellin's responsibility to ensure his patient's wishes were carried out during the operation at Canberra's John James Memorial Hospital on November 12, 2003.
Dr Armellin countered by saying the birth mother only told him she wanted one embryo minutes before she was sedated, after previously signing a form consenting for up to two embryos to be implanted.
The case, before Justice Annabelle Bennett, sparked nationwide condemnation of the women in the media.
The mothers issued a statement during the civil proceedings arguing the case had nothing to do with their feelings towards their daughters, but with Dr Armellin's failure to comply with their wishes.
"This has never been a case about whether our children are loved," they said.
"They are cherished."
The couple's solicitor Thena Kyprianou said her clients, who live in Melbourne, were shocked by the decision.
"They're disappointed," Ms Kyprianou said.
"They said they are shocked and that they will consider their options further once they have an opportunity to read the judgment."
Ms Kyprianou said the publicity surrounding the case had destroyed her clients' privacy.
Dr Armellin's barrister Kim Burke said her client was relieved but mindful the women have 28 days to decide whether to lodge an appeal.

Suspects will also be prevented from pleading not guilty to murder by claiming it was a "crime of passion" because their partner was having an affair.
The reforms are designed to ensure domestic violence is treated as other forms of homicide.
As a result of the changes, battered wives who kill their abusers will be able to defend themselves against a murder charge by claiming diminished responsibility.
Following several years of consultation, the Government will next week announce the end of the "crime of passion" defence of provocation used by virtually all male defendants pleading not guilty to murder of a female partner.
Around 100 men a year kill their former or current partners, and provocation - such as failing to cook a meal, or persistent nagging - is the main form of defence used by barristers.
Relatives have complained that they have found it upsetting when murder suspects invoke lurid allegations about the victims' private lives.
In contrast, it is comparatively difficult for lawyers representing the 30 women a year on average who kill their partners to argue that they were provoked, as the crime tends not to take place in the heat of the moment, but is typically pre-planned.
While provocation is likely to remain on the statute book as a defence, it will be limited to the most serious instances, and will not include adultery or nagging.
The reforms are based on a 2006 review of the homicide laws by the Law Commission, and are backed by groups ranging from the Association of Chief Police Officers to Justice for Women.
At the time, the Commissioners complained that the murder laws were "a mess" and said that while appeal judges often did in practice free battered women who killed their abusive partners, this was not available as a straightforward defence in the first place.
One of the Commissioners, Prof Jeremy Holder, told The Telegraph: "The provocation laws have been a constant source of problems for the courts. To a large extent, there is a desire to be more lenient in the sympathetic cases, such as battered women, but the courts lack the laws to address this."
The proposed changes were welcomed by women's groups and law reformers.
A spokesman for Justice for Women said: "We welcome a change in the law. The women we deal with kill in desperation after suffering broken limbs, rape and constant fear. In contrast, at the moment men can get off a murder charge just because their wife is considered a nag."
Emma Scott, spokesman for Rights of Women, said: "Rights of Women has long had grave concerns that the current law continues to discriminate against women who kill and that the defence of provocation in particular is entirely inadequate in dealing with these situations."
In 1997, Joseph Swinburne was sentenced to 200 hours community service after he stabbed his wife 11 times when she told him she was leaving him for another man.
Kiranjit Ahluwalia was jailed for life for killing her violent husband in 1989 by setting his feet on fire following years of abuse. She was freed on appeal three years later, and her story made into a film.
The changes will also make it easier to prosecute gang members who join in an attack which results in murder, even if they did not wield the knife themselves.

IF TV farmer and Deniliquin desperado James is wondering why he's hit a dry spell with the ladies, he might perhaps consider whether it has something to do with what's coming out of his mouth.
Dissing the women he's meant to be wooing on Nine's matchmaker series, The Farmer Wants A Wife, the 36-year-old sheep and wheat man has dipped himself in it by blasting his two "picks".
Suffering from a bad case of foot-in-mouth disease, James first bagged one suitor, Cherie, as being "rough as guts", then condemned the other, Toni, as no more than an aging "body clock".
The blond boofhead made the remarks, sure to win him no female fans, after deciding against dating either of them.
"I chose Cherie because Ithought she was a character, but once I got to know her she was as rough as guts," James said in the latest edition of TV Week.
"She needed a 44-gallon drum of spit to shine her up! The only reason I picked her was because I didn't have much choice. Some of the other guys had 200 women apply, but I only had 24," he said.
"Toni was the next pick - she's got her head screwed on and owns a house, but I'm really looking for someone a bit younger.
"She's 36 and when someone is that age, the old body clock is ticking. You want to know someone a couple of years before you jump into (having kids)."
While the fussy farmer will be forced to make his intentions clear on next week's episode, the women he slighted said it all yesterday - with their silence.
A spokesman for the show was unable to contact Cherie, but said Toni "politely declined (to comment) and doesn't want to enter into a debate with James".

Her lawyer Colin Amery says his client is extremely remorseful. On Thursday, she said sorry in a letter to the court, especially to genuine rape victims.
"I hope that my actions do not stop you from seeking help and coming forward and seeking help because the help that is available from the police and from other support agencies is the absolute best that is available and at every moment you will be treated with respect," she says.
The police officer in charge of the case, Neil Grimstone says the genuine victim will be treated professionally, with courtesy and sympathy, "however the liar will be found out and will be fronted before the courts".
It appears the motive in this case was love - a brief affair with a married man ended but she wanted him back.
"It was an attention seeking situation," says Grimstone.
The court heard how May cut her phone line, tore her clothing, injured herself and ripped out clumps of her own hair to make the rape look real. When she was finished, she told police she then physically made herself throw up.
It's not the first time May has cried rape. Police say investigations uncovered another false allegation three years ago.
"She's obviously going to try and put her life back in order. It's a very difficult time for her," says Amery.
"It's the start of the process. That's all I have to say now, thank you," says May.
And this case has another cost - nearly $60,000 from a police investigation totalling 670 man-hours. Grimstone says that's a huge amount of time and effort.
May had no supporters in court on Thursday. She will undergo a psychiatric assessment before she is sentenced next month.
The charge of making a false statement carries a penalty of three months in prison or a fine of up to $2,000.

Their suspicions were confirmed by finding the alleged rapists -- 15- and 16-year-old boys -- who said the sex was not forced.
During subsequent interviews with police, Kelly says Giles corroborated the boys' claims. Giles was booked on four counts of carnal knowledge of a juvenile and one count of criminal mischief, for filing a false police report.

"I didn't dare tell anyone what I was being accused of for fear that the other prisoners would beat me up," he said.
"Instead, I told everyone I was in for violent assault. This has been devastating, for me and my family. Not one of us had ever been in trouble before."
Mr Haque has always maintained he picked up the girl in March 2003 after she had been walking home from a night out at the Trafford Centre and that they had consensual sex. He believed she was a much older teenager. He said the girl, who also claimed that she had been raped by another man prior to be picked up by him, had got willingly into his car.
After they had sex he offered to take her home, but added: "She told me to drop her at the bottom of her road because she didn't want her father to know she had been out with a stranger."
"I realise now that what I did was foolish, but that is only with the benefit of hindsight. At the time, I honestly believed I was with a much older teenager."
Two other men were charged with indecent assault on the 15-year-old girl but the charges were dropped before they reached trial, last September, said Mr Alam.
"I find it very hard to explain to my client why he had to spend so long in prison, waiting to be cleared of all charges, when the prosecution have admitted that they always knew they had less than a 50 per cent chance of gaining a conviction," he explained.
"He has lost a huge chunk of his life and will never get it back again."

In the report, Ms. O'Brien claimed that a white male forced her out of her car and raped her at gunpoint in a secluded area on South Shore Beach on Wednesday, Feb. 11. Sergeant Antone Marion and Patrolman Daniel Martin spent two hours interviewing Ms. O'Brien that day.
Rhode Island State Police were called in to assist in the investigation. Two Little Compton police officers were called in from off duty and were paid overtime for their work securing the crime scene and combing the beach for evidence.
After an additional interview with Little Compton and Rhode Island state police, Ms. O'Brien recanted her story on Friday, Feb. 13.
Making a false police report is a misdemeanor which carries a fine of up to $500 and up to a year in jail. Acting Police Chief Lt. Sid Wordell said he does not expect prosecutors to push for jail time for Ms. O'Brien, but that it is likely she will pay a fine.
"The penalty isn't based on what crime she reported. The penalty is based on case law for the crime of filing a false report." Lt. Wordell said.
Police are also asking that Ms. O'Brien refund costs they incurred during the investigation.
"As a part of this case we are going to request restitution for any expenses incurred by the Little Compton Police Department and any other agency that assisted," Lt. Wordell said. "If a suspect commits a crime and there are expenses, the victim can request they be paid for by the suspect. In this case [Ms. O'Brien] is the suspect and the victim is the police departments."
Police idid not uncover Ms. O'Brien's motive for making the false report, Lt. Wordell said. Ms. O'Brien grew up in a town near Little Compton and had frequented South Shore Beach in the past.
"When anyone reports a crime of any type of serious nature it heightens a fear in the town," Lt. Wordell said. "The original report was that there was a male raping a female at gunpoint so the fear level is increased that this type of a person may be out there to do that to someone else. The public should always be aware that this is a possibility, that this could happen. We're not immune to these types of crimes. Anything can happen even in the town of Little Compton. When someone makes a report like that, it falsely raises those types of fears and there are consequences that go along with that."

If someone was trying to sexually assault me with grabs, knees and so forth against my will, I'm pretty damn sure most guys would do whatever it takes to protect themselves accordingly... police included.
