Ho-Hum. Another Day, Another Life Destroyed

"I had to file bankruptcy," he said. "I lost it all; I lost my business; I lost my clients; we lost two houses; I lost my savings; I lost my kids money for college; I've lost everything."

That's Darryl Berenson of Loxahatchee, Florida. It's hard to tell, but he's actually quite happy because, although penniless and destitute, at least he's not in prison. As this article tells us, that's where the State of Florida wanted him (Tampa Tribune, 3/17/10).

The state wanted him there because his ex-wife wanted him there; she wanted him there because he got custody of her kids.

Yes, you read that right. I wrote "her" kids because they're hers, not Berenson's. He's not their natural father, but a judge awarded him custody anyway which may give you some idea about his ex-wife's fitness to be a parent.

As Berenson himself said,
"She lost custody to the non-biological father," he said, adding that isn't something that happens often in Florida courts.

In addition to everything else, it looks like Berenson is a master of understatement.

Back in 2007, Berenson and his ex were locked in a custody battle, when the judge awarded him sole custody of the two children, now aged 11 and nine, in an emergency hearing.

So his ex told police that her computer had been hacked and she believed Berenson had done it to get a leg up in the custody case.

Berenson was arrested and charged with 16 counts of computer illegality. When he pointed out to police and prosecutors that getting an advantage in the custody case was an unlikely motive since he already had custody, they turned a deaf ear.

When he pointed out that an above average 12 year old could intercept his wireless signal to make it look like he had hacked his ex's computer, they did the same.

But it wasn't just being charged with multiple felonies that was the problem. No, that came from the fact that he owned a security company and, in Florida, anyone who's charged with a felony has his license to operate one of those revoked.

Berenson's six-figure income vanished, his customers went elsewhere and he checked into bankruptcy court.

Despite his adamant claims of innocence, despite his ex-wife's obvious motive and despite there being no evidence against him, prosecutors were relentless. Berenson couldn't afford an attorney, so the state appointed one to represent him.

The attorney prepared for trial, but the day it was to have begun, the state announced casually that Berenson was free to go; all charges against him were dropped.

A spokesman for the DA's office said,
"After further investigation of the case, our office determined there was not sufficient evidence to establish guilt beyond a reasonable doubt."

Although the specific facts of Berenson's case are unique to him, this is the type of thing that's pretty common - the use of criminal allegations to try to get leverage in custody disputes.

Strangely enough, prosecutors don't seem to see what's obvious to the rest of us - that allegations like that are likely to be false. The plain facts of Berenson's case, fairly scream "Don't trust this woman! She just lost custody and is out for revenge!"

Several months ago someone did a study that suggested that, in the presence of an attractive woman, men cease to think clearly. Maybe the same is true when men are faced with mothers in custody matters - they behave irrationally and can't seem to see the obvious.

Let's see. By her false allegations, Berenson's ex-wife destroyed his business and bankrupted him.

She wasted the time and money of the taxpayers of the county; she wasted the time of prosecutors, judges, police and court personnel.

The taxpayers paid for Berenson's attorney.

His employees had to find new jobs, at who knows what cost to their spouses and children.

Berenson doubtless underwent extreme emotional turmoil while all this was going on.

And she did it all with absolute impunity.

The Queen of England wouldn't be any more safe from the arm of the law than is Berenson's ex-wife. Indeed, she's so protected that she's not even named in the article.

And Berenson's children?

His son, now 11 and daughter 9, were both doing well, through it all, he said.

Well, they're probably too young to appreciate the gutting of their college funds, but it's good to know they aren't suffering too much psychologically. But that does bring up another issue.

In child support cases and in the laws that control them, we're constantly reminded that everything is justified for the sake of the child. The most draconian laws denying any semblance of due process are explained away by the simple phrase "for the children." And, however wrong, however unfair, unjust or nonsensical the laws may be, children do need support.

So what about Berenson's case?

His ex-wife totally destroyed his ability to support his children and their living conditions declined precipitously all because of her false claims made apparently with no other thought in the world than to exact revenge against Berenson for his unforgiveable sin of being a better parent than she.

A man is ruined and his children's present and future wellbeing are jeopardized and as far as I can tell, not a single state official has considered the possibility that the ex did anything wrong.

Ah yes, a telling question. For those with no sense of justice or fairness, no conscience, no heart, no soul and no vision of how much better the world could be if they were capable of looking outside of their own blinkered selfishness, it would have appeared to be very much worth it.

A vindictive woman gets her revenge - she thinks it was worth it.

A whole bunch of state minions - the police, the prosecutors, the judges, the court personnel - get to draw their salaries, go home to their families and sleep soundly at night with a clear conscience because they believe they have done a good job. They think it was worth it.

The feminazis rubbing their hands with satisfaction at the sight of another man crushed will think it was worth it.

The politicians who made these filthy laws that allow such horrors to take place day after day will think it was worth it.

The media who can use the story to fill a few column inches before they rush madly on to the next bit of cheap news will think it was worth it.

The uncritical mass of people who have been brainwashed into believing this is a fair system, that they live in the land of the free, and who vote in their millions for people who enjoy destroying the lives of others, will think it was worth it. If they think at all, that is.

In fact it is frightening to consider just how many people will think it was worth it. And until someone or some cataclysm teaches them exactly why it isn't worth it, the tide of misery will continue.

Doubtful. There are too many people and agencies that either harmed him or did nothing to help him. They'll protect themselves. It's also hard to get legal representation for such an effort as the lawyer will shy away from making trouble for groups with whom he needs to get along.

The UK. is now financially bankrupt as its assets do not cover the national debt. If the loss of social cohesion is added to the problem, it is unlikely any politician will have the nerve to avert the cataclysm.

Thanks for noticing RV. I guess I need to update my stuff though, I moved to North Carolina over a year ago. After about two years up there with no visitation taking place (blocking / alienation by my exe/ no help from the courts) I headed down south to help my sister who is disabled. I figured I could be anywhere and not see my son… It's like he is dead. He lasted about 4-5 years after the divorce and then he folded under the pressure from his Mom. Sigh.
