New laws will regulate paternity tests in Germany

From next year on, new laws will regulate paternity tests in Germany, and it will not be possible for the wife to resist the paternity test. Up to the end of this year 2007, the wife or ex-wife is still able to object any paternity test in court out of various reasons.

The new law says clearly, that the father, the mother and the child, independent from each other, have the right to carry out the paternity test without offering any reason, why they want to do that.
Married or already divorced, living with the child or not, does not matter.

The principle: 'the best for the child' will be changed in future - it is only applicable if the child has a very serious problem, like being handicapped. In the future children will know, who is the father or better, who is not the father.

These tests have to be reported BEFORE being carried out to a court, testing in secret is not allowed.

The new deadline to question father's obligations and child-support will be 2 years after this paternity test, however in special cases this deadline might also be questioned in court from next year on.

Many cases older than 2 years are formerly rejected due to the old law which will be questioned again in family court under the new law next year.

Many German fathers are paying for child support, but they are not the father. They know, they are not the father, they filed lawsuits about it, still they have to pay.

This was the old law - the new law might give them some hope....
