    A Gatineau father has asked Quebec's highest court to rule on the
    rights of parents after a lower court ordered he overstepped his
    bounds by prohibiting his daughter from going on a school trip.

    The Quebec Court of Appeal in Montreal heard arguments Tuesday in the
    case of a 12-year-old girl who took her father to court after she was
    grounded.

    In June 2008, the girl was preparing to go on a three-day trip with
    her Grade 6 class to Quebec City to celebrate their graduation from
    elementary school.

    However, the father told the girl she was not allowed to go after she
    disobeyed his orders to stay off the internet.

    The girl, whose parents are divorced, got a lawyer and took the
    matter to Quebec Superior Court.

    Judge Suzanne Tessier ruled in June that the father didn't have the
    right to bar the girl from the outing.

    In her ruling, the judge said there was no reason for the punishment
    to stand, since the girl was living with her mother, even though the
    father had custody at the time. The judge said the punishment was
    also excessive.

    The father has since given up custody of his daughter. However, his
    lawyer said he appealed to clarify the rights of parents in such
    situations because he still has custody of his three other children.

    A man's lawyer argued before the three-member appeal panel Tuesday
    that he was only exercising his parental rights.

    The judges have reserved their decision.

    This is crazy.

    I remember a case in the US where a dad was jailed for his daughter failing to obtain her GED.

    It's the nanny state in full force. Now the state gets to tell you how you can discipline your kids, too. Lovely. Maybe we need a commission to establish federal guidelines on appropriate punishments for various misdeeds of our kids. Compelling state interest there, certainly.

    It is. I think it demonstrates that once we start letting the state too close to our interpersonal relationships, it will become hard, ultimately, for the state to draw the line as to where that intervention should stop.

    i can't wait for these judges to decide--i cannot see how they will judge this with-out hanging the family courts. imho there is no answer they can give until something or someone sets the presidence for such a decision

    of course one has already been set-hasn't it?

    This girl was grounded for putting provocative pics of her-self on the net.

    Dad says "no",and she does it again.....this is what lead to the grounding in the first place--if i am not mistaken'?

    Soooo....your little girl can do this,and if u punish her or attempt to...she can go to court?(little boys,also)and let the "state" decide,and if u have a sympethitic judge-your word means nothiing?WTF?

    this is opening a door that the courts,I am sure do not wanna open-No matter what happens,the family courts will be put under a microscope,and we can help-if we all exploit this incident -properly.

    There is NO answer the judges in my opinion,can come up with,that is not gonna piss someone off-BIGTIME

    Ah, but what the judge saw was the patriarchy oppressing the budding sexual expression of an inherently superior young female -- and simply assisted her in casting off the injustice of the father's pathetic patriarchal attempt to suppress her inherent female sexual power. You go girl!

    If it would have been something other than a SCHOOL trip it would not have been such an issue I imagine, as far as the state is concerned..

    I have noted that there seems to be a tendancy for the state to regard school as the place where kids are raised and disciplined, so school trips (which are another way of getting kids off parents) are a higher priority than ANY time spent with parents..

    The state has already stolen most of our childrens waking hours off parents, it has become a beast that no longer regards itself as SERVING parents, but clearly thinks that parents must serve the state..

    Single mothers could do an interesting experiment..

    Deny their children their fathers..

    And at the same time deny children their education..

    I wonder what would have them punished faster?

    I was thinking along the same lines...she didn't come up with that idea all by herself.

    And yes...I think it's highly possible her mother put her up to it, and not for the "best interest" of the girl, but for the mother's own "personal" reasons.

    Actually, kids are "empowered" above parents as anyone who has had dealings with social services and other shit-stirring agencies will inform you..

    Its just like Orwells 1984, where kids are used as agents of the state to snitch on their parents..

    Of course, mothers dont get the shit as much as dads, because women are naturally very compliant of the bigger bullies they have dealings with..
