Victoria Stafford disappeared in April 2009. (Family photo) A 29-year-old man charged with the kidnapping and murder of eight-year-old Victoria Stafford will go straight to trial and won't get a preliminary hearing.
Michael Rafferty's hearing was scheduled to start June 21, but the Ministry of the Attorney General is now proceeding with a direct indictment.
"Direct indictments can be used in cases where there are compelling circumstances that require, in the interests of justice, that the matter be brought to trial as soon as possible," Ministry spokesman Brendan Crawley said in an email.
While Crawley could not comment specifically on Rafferty's case, he said direct indictments are used when Crown counsel has concluded there is a "reasonable prospect of conviction."
Preliminary hearings are held to see whether there is enough evidence to go to trial.
Rafferty's lawyer, Dirk Derstine, said he is disappointed with the decision.
"I think that the preliminary inquiry is an excellent place for starting the process of determining whether a case is proper or truthful or not," Derstine said.
"We're not particularly happy it's being taken away from us."
The Ministry's reasons, including saving time, don't justify the "extraordinary step," Derstine said.
"It won't have sped up the trial probably by one day."
No date has yet been set for Rafferty's case to return to court, but Derstine still expects his trial to take place some time in 2011.
When Victoria, known to her friends and family as Tori, failed to return home from school on April 8, 2009, in Woodstock, Ont., it set off a desperate search that gripped Canadians across the country.
Terri-Lynne McClintic, 20, and Rafferty, 29, were arrested the following month and charged with first-degree murder and kidnapping.
Tori's remains were not found until more than three months after her disappearance, about 100 kilometres from her home in a field north of Guelph.
Court proceedings in McClintic's case are under a sweeping publication ban.

Rafferty, 31, is charged with first-degree murder, sexual assault and kidnapping.
Stafford, a Grade 3 student, was abducted while walking home from school on April 8, 2009 in Woodstock, Ont.
Those hopes were dimmed when Rafferty, and his ex-girlfriend, Terri-Lynne McClintic, were arrested on May 20, 2009.
The little girl's remains were found nearly two months later on July 19, 2009 on a rural road southwest of Mount Forest, Ont.
In April 2010, McClintic pleaded guilty to first-degree murder in the case. Her plea was put under a highly criticized sweeping publication ban until December.
The now 21-year-old, also from Woodstock, is currently serving a life sentence with no chance of parole for 25 years after she admitted to randomly choosing Stafford and lured her with the promise of seeing a puppy.

Terri-Lynne McClintic, who pleaded guilty to the first-degree murder of Victoria (Tori) Stafford, will testify today against her former boyfriend, who has denied taking part in the schoolgirl’s killing three years ago.
Michael Thomas Rafferty’s trial began last week in London, Ont. The 31-year-old has pleaded not guilty to first-degree murder, sexual assault causing bodily harm and abduction.

So that's why the trial is taking place so soon, after only 22 months. Hmm, I can see that the Attorney General is clearly speeding up the trial process in this case.
If he's guilty, I hope he gets a good long spell away. It's good to see that the woman got 25 years minimum even though she pleaded guilty.____________________________________________

The testimony given in a London courtroom this week by Terri-Lynne McClintic was numbing. Eight-year-old Victoria Stafford suffered horrific torture and a death that no child, indeed no person, should ever have to endure. Her shattered innocence sears the conscience of a nation; parents hold their children tighter, outrage boils on the Internet, and hearts break for the family and friends who will grieve her forever.
What is the appropriate response of the state in a case like this? McClintic pleaded guilty, and will serve a life sentence with no possibility of parole for 25 years. Michael Rafferty has pleaded not guilty, and stands trial for rape and murder. If convicted, he could also face life in a maximum-security prison.
But in these circumstances, is that good enough? Canada may have outlawed the death penalty in 1976, but in the wake of this case, the issue has again become a topic of debate in the media and at the dinner table — yet not in the halls of Parliament.

2 assault charges for attacking her mother,makes me wonder if this was considered d.v.?
McClintic admits 'history of violence' in court
Tara McDonald, that she believed McClintic was the woman who had been spotted walking with Tori when she was last seen alive on April 8, 2009.
Good thing this little girl was considered safe because she was last seen with a woman and no amber alert was called.
