The government fears the ruling could set a worrying legal precedent
A French court of appeal has overruled the decision to annul the marriage of two Muslims because the bride had lied about being a virgin.
They are now effectively married again - even though both partners said they accepted the original judgement.
That verdict had caused emotional debate and outrage among some feminists, who said it amounted to a "fatwa" against women's liberty.
But the husband's lawyers said the case had nothing to do with religion.
They argued that the wife had breached the wedding contract, and tricked her husband into marriage.
Under the French civil code, a marriage can be annulled if a spouse has lied about an "essential quality" of the relationship.
'Kandahar-style'
According to media reports, the husband, an engineer in his thirties, married the trainee nurse in the summer of 2006, having been assured by her that she had never previously had a boyfriend.
The woman admitted having lied about being a virgin, and later accepted the court annulment.
Her lawyer said she did not want to contest the judgement, and simply wanted to get on with her life.
But Justice Minister Rachida Dati ordered a review of the verdict, which was referred to in some quarters as "a real fatwa against the emancipation of women" and "a ruling handed down in Kandahar".
Feminists argued the decision was unfair because a woman would not be able to cancel her marriage if she thought her husband was not a virgin. [How are the femmies so sure about this? It's a moot point in any event, because females don't seek or value virginity in male so such a case wouldn't arise in the first place, and they know it. Typical feminist warped argument.]
Critics have also asked if the judge would have ruled the same way if the marriage was not between two Muslims, and claimed the decision was incompatible with France's secular principles.

Re: French Court reverses Muslim virgin marriage ruling
I expected something like that and I am not surprised.
Best solution is ALWAYS for a man in the Western world to remain single.
Do not marry! Any marriage contract is a trap... full of obligations for the man, and nothing, but really nothing in return for him.
Say NO to marriage in Western countries.Yohan's

Point accepted Yohan, but as an MRA position IMO that does not go far enough.
I've always advocated for a total lack of State involvement in marriage registration, divorces etc. Taking marriage/divorce off the statute books.

Re: French Court reverses Muslim virgin marriage ruling
the Philippines divorce policy has completely confounded the feminits and their tactics of dumping their marriage contract and running off with the loot
they have no divorce in the Philippines
the women in the Philippines can't get custody can't garnishee his wages can't tell outrageous lies about husband molesting his kids
cause the courts just don't process such claptrap in the Philippines

Feminism > Multi-culturalism
Just add it to the list of things feminism trumps.

Re: French Court reverses Muslim virgin marriage ruling
You know France has just pissed off the muslims over there, you can bet this is just going to push them all more and once France reaches meltdown it's going to get ugly, been hear about muslims causing riots and basicly demanding speical considerations because they are muslim.
As for the Philippines from what I have heard is they men and women over there still love one another, maybe it's because they are a 2nd world country that men and women still have a need for one another and that it's because of the hardships over there econmonicly that they try to work things out, or maybe they have seen what feminism has done and the west and seen it as the slow death and decay that it is over here and said " No Thank You. "

Re: French Court reverses Muslim virgin marriage ruling
In case of a Filipino man living somewhere in a village or in the slums, I wonder, if the wife can punch him so easily without immediately receiving the same in return...so-called equals - sharing violence.
Yes, of course in Philippines, women can leave, but they cannot claim lifelong alimony from the ex-husband...as they are still married over years - alimony for an ex-wife does not exist in the Philippine law. Even an ex-wife does not exist, only nullification of the marriage certificate is possible, a procedure which is costly and takes many years.
Of course, they can leave and sleep with another man all the time, but they cannot accuse the husband of spousal rape as a reason for divorce.Yohan's

Re: French Court reverses Muslim virgin marriage ruling
Not always as simple as that sadly.
So I take it they can't get married again unless they have that nullification? Sounds like a weird system though maybe it is what we need! I do feel a bit uneasy about possibly being attached to someone for the rest of my life even if she is a nutter. Then again I don't plan on getting married so it wouldn't effect me.In case of a Filipino man living somewhere in a village or in the slums, I wonder, if the wife can punch him so easily without immediately receiving the same in return...so-called equals - sharing violence.

Re: French Court reverses Muslim virgin marriage ruling
As many folk will tell you, that peice of paper (or ability to change the status on it) means very little when it comes to protecting yourself from nutter..
The problems with marraige etc come because the state uses that piece of paper to control people.
