Man freed after being exonerated of rape
This is semi-good news.he shouldn't have been in prison in the first place since he was innocent, but it's great that he's being exonerated. What makes this infuriating is that no charges will be brought on his accuser. This, despite her having sued the school district over what happened and being awarded over a million dollars.According to a news report, she didn't want to come forward with her lie sooner because she didn't want to have to give the money back.
He went to jail 10 years ago, taking a promising football career with him. He got out but struggled to find his place in society. Who wants to be around a registered sex offender?
If you’re sick of pampered athletes getting away with murder, Banks’ story was a satisfying read. There was just one problem.
He was innocent.
In a Los Angeles courtroom Thursday, it took all of 30 seconds for a judge to exonerate Banks.
“I haven’t smiled like this in 10 years,” Banks tweeted Friday morning. “I’m FREE.”
He’s not just free from his past. Banks is not going to be a prisoner to it.
He stood outside the courthouse in a sweatshirt inscribed with the word “Innocent” and said he’s not dwelling on the woman whose lies sent him to jail.
“I can hold onto that, that bitterness and that anger,” Banks said. “It won’t get me anywhere.”
He’s a better man than me.
It’s hard to fathom how one concocted story could carry such weight. If it doesn’t make you want to reform the justice system, it sure makes you want to scream at Wanetta Gibson.
She was 15 and Banks was 16 when they went to the “makeout spot” at Polytechnic High in Long Beach. He was also a 6-4, 225-pound linebacker being recruited by USC and other top football programs.
The teenagers fooled around as teenagers do. But they did not have sex. Then they returned to class.
“By the end of the day,” Banks said, “I was in custody.”
Football recruiters suddenly stopped calling, though that was the least of Banks’ worries. He faced up to 41 years in prison. Prosecutors offered a plea deal that would get him out in five.
Even though there was no DNA evidence, Banks’ attorney advised him not to take the chance of staying in prison until he was 57 years old.
“She told me I was a big black teenager,” he said, “and no jury would believe anything I said.”
Banks spent five years and two months in prison. He had another five years on probation. Banks had to register as a sex offender and wear an ankle monitor.
He figured he’d never get his good name back. Then last year, Gibson contacted him on his Facebook account. She wanted to let “bygones be bygones.”
Easy for her to say. Gibson had sued the school district for not providing a safe environment and received $1.5 million. Banks was flabbergasted that she wanted to become Facebook friends, but he saw it as an opportunity.
“I stopped what I was doing,” he said, “and got down on my knees and prayed to God to help me play my cards right.”
He set up a couple of meetings with Gibson. She admitted she’d lied and wanted to help Banks clear his name. But there was that $1.5 million hitch.
She wouldn’t talk to prosecutors, but Banks secretly recorded the conversation. He contacted the California Innocence Project, a law school program at California Western School of Law.
Attorneys took the evidence back to the original judge. At Thursday’s hearing, his record and name were cleared.
Banks broke into tears.
“There are no words in any language, no gesture in any culture that can explain or describe what I have been through,” he said.
Gibson didn’t attend the hearing. The district attorney said it’s unlikely she’ll be face any charges. The case is 10 years old and she was only 15.
I think she should spend as much time in jail as Banks. And if I were a Long Beach taxpayer, I’d sure want that $1.5 million back.
She should give it to Banks. Though how can anyone or anything make up for what he has been through?
“It’s been a struggle,” he said. “But I’m unbroken, and I’m still here today.”
He even has rekindled his high school dream of playing in the NFL. If not at his old linebacker position, at least as a special teams performer.
Banks started working out in October and has lost 50 pounds. Now he has dropped the heaviest weight of all—that ankle monitor that reminded everyone he’s a convicted rapist.
It’s crazy to think Banks would actually make a pro roster, but it would be nice to see him get a tryout. The NFL certainly has no problem finding room for players who were rightly accused of crimes.
“Let me show you what I can produce,” Banks said on NBC’s Today show. “I think that any team that gives me an opportunity will be really impressed with what I can do.”
If nothing else, they’d have to be impressed with his attitude. Banks was supposed to be the guy we’ve all learned to loathe.
It turned out he’s the kind of guy we should all strive to be.

Re: Man freed after being exonerated of rape
Even if Brian Banks doesn't make the grade as a player, think what an inspirational coach he could be!
Imagine you're 6 points down at the end of the fourth quarter, 4th and fifteen deep in your own half, with 1 minute left on the clock.
Then THIS man calls a time out and tells you his life's journey.
You would run through a brick wall for him.Last edited by Oneinthree; 26th-May-2012 at 11:58 AM.

Re: Man freed after being exonerated of rape
Here a couple of quote from Banks:
“I can hold onto that, that bitterness and that anger,” Banks said. “It won’t get me anywhere.”
And here's one from I got from another news site:
"It's been a struggle. But I'm unbroken, and I'm still here today,"
Like the article above says at the end, here is a guy that we should all strive to be like. This is something worth fighting for.THE LAST LEGIONARY

Re: Man freed after being exonerated of rape
It's wonderful that this guy can put the nightmare of his past behind him. What I find disgusting is that the woman won't face any legal repercussions and the only reason she came to meet him was because of the 1.5 million she had won in a civil case against the school and school district, did she feel guilty?
And there is the reason she wanted to "become friends and let bygones be bygones". She wouldn't speak to the prosecutors to clear the man's name.Banks was flabbergasted that she wanted to become Facebook friends, but he saw it as an opportunity.
“I stopped what I was doing,” he said, “and got down on my knees and prayed to God to help me play my cards right.”

I hope this guy can rekindle his dream is some fashion. I also hope he finds a way to take that lying excuse of a human being to court for damages.Last edited by The Possible Human; 26th-May-2012 at 03:22 PM.

Innocent NFL Prospect Did 5 years in Prison For A False Rape And Kidnapping Accusation
After 5 years in prison, former prep football star exonerated for rape, kidnapping | Prep Rally - Yahoo! Sports
So fake, "let bygones be bygones"? Yet, she didn't apologize for what she did, not that it would make it better nor did she admit being wrong. In fact, this was to make HER look good, probably. This is a fake truce if I've ever seen one!As reported by the Associated Press, Good Morning America and a variety of other outlets, 27-year-old Brian Banks was officially acquitted of the violent charges against him after his accuser recanted her story after a bizarre turn of events that began when the woman reached out to Banks on Facebook.
While the accuser, a woman named Wanetta Gibson, told Banks she wanted to "let bygones be bygones", she was hesitant to repeat the story she told the former Long Beach (Calif.) Polytechnic High football star to prosecutors because she was afraid that she would have to forfeit the $1.5 million civil settlement her mother won against the Long Beach school district in connection with the case.
Anyone else sick of this shit? We believe women falsely cry rape? No, we know it! If it is so hard for victims to come forward then why do they do so with such ease now? And even though she's saying "victims" I know she means women. Even her mention of rape victim excludes raped men. What about now? It's already hard for men who are raped to come forward. Now it is hard for victims of false accusation to come forward and defend themselves from such claims. I am sick and tired of women trying to usurp an issue and make it about women when a man is the victim. I bet you she has no interest in protecting innocent, falsely accused men of prison rape.Shannon • Fairborn, Ohio • 13 hours ago Report AbuseAnd this is why so many men believe women falsely cry rape. And it will be harder for victims to come forward in the future. She should go to jail for ruining that man's life. Unbelievable.
And spare me of mentioning that she admits that this woman should go to jail for ruining a man's life. What? Should she get a medal for that? For stating the obvious? No, this isn't unbelievable because it happens everyday.
Yeah, I bet you still do get on men's cases about saying women falsely cry rape. What an heavy admission of sexism by believing that no woman would be cruel and cold enough to ruin a man's life over something that has never happened. Women do these things everyday with the family courts, too. I've been accused by a woman of having gender pride (thinking my gender is better is what I presume that to be). This is an exemplification of what gender pride really is and this is a big part of the reason why I don't trust women.32Thumbs UpThumbs Down3
Shannon • Fairborn, Ohio • 12 hours ago Report AbuseAnd I used to get on men's cases about saying women falsely cry rape. And I believed no woman would be that cruel and cold to ruin a man's life over something that never happened. And this woman just set everything about rape back about 30 years. Now when a woman is really raped, the rapist can just say, "She's making it up," and walk because even if it's true, there will always be some doubt and then victims won't come forward because they fear no one will believe them. And that is not right. She should suffer for that.
Plus, you can't explain things to women because they "don't get it" no matter how basic it is. I don't believe that "no man would ever _" I believe that women get away with things that men don't get away with doing. I'm sick of them only bringing up when a woman is really raped when a man is falsely accused of rape. What? Should we treat a false allegation of rape as if it really happened? Should we automatically believe a woman's allegation.
I believe that this woman only believes a woman should suffer because of what "she did to" real rape victims and not so much what she did to an innocent man. Shit, when a man abuses a woman do we complain that "now no one will believe us when we really are defending ourselves against a woman" or do we just condemn the man?
You know what? This is my policy for now. As long as women (same goes for men but this is more common in women) automatically believe a man is guilty when a woman accuses a man of rape or any crime I will automatically believe their asses are guilty and "like that" too. I will not trust a person who thinks along those lines. I actually think that this is a very sensible assumption to make.Last edited by Popadibs; 26th-May-2012 at 04:55 PM.

Re: Man freed after being exonerated of rape
This isn't wonderful news, Marx, you're being SOFT, S-O-F-T, SOFT!
This is bittersweet news because while an innocent man was released (the good news) he has lost 5 years of HIS time! The evil ankle that accused him, surprise surprise, has gotten no charges against her! This system still encourages her behavior and still punishes innocent men like you and I! WHAT HAS CHANGED?! And you say this is wonderful news? It would be good news if she went to prison for the same amount of time he would have gone to prison for + the time that he has already served in prison. It would be wonderful news if the women using the system against men like this were all made to pay! It would be wonderful news if the innocent men that are accused didn't have to suffer such a loss! And it would be wonderful news if the system that allows these things (including those running it) was overthrown! Men set their standards far too low!
The playoffs aint good enough for me! I want to win! Men need to be far more ruthless against such individuals than they are (or far less tolerable).
She needs to be kicked in her fucking clit! Just for good measure and then told to "let bygones be bygones". That wouldn't fly, though, would it? And neither should this! WE should have no tolerance for women like this (just as we have no tolerance for male rapists) and we should have no tolerance for the women NOR men that defend such women or deflect from the real issue, neither.
Oh, and I didn't see this until after I posted a thread on this.
We are being warned ahead of time that many women will offer up a false truce, as this woman did, and we'd be wise not to ignore the warnings. When I do this, and I know I will, it will be comparable to the lame learning to walk, the blind being enabled to see and the suffocated breathing again. The sky isn't the limit; there are no limits.

Re: Innocent NFL Prospect Did 5 years in Prison For A False Rape And Kidnapping Accusation
As long as men' identities are splashed in the press and he gets "perp walked" for the cameras and media, I will side with the man until it is proven, really proven that he committed a crime. False accusations by women against men are often pushed aside by the media and the general public as just another example of men and the patriarchy. As long as women believe they can blackmail men and falsely accuse them for any host of reasons, I will side with the men.
I have a friend who was false accused of rape. The case went to trial. Even with a TON of evidence against the women, the case was still prosecuted due to no drop prosecution laws. He was exonerated and had to get another verdict being declared "Innocent" of the crime. He lost his job and a lot of fair weather friends, even his family distanced themselves from him.
That was 10 years ago and he still has a hard time finding a good job, despite his exoneration. So he did what he had to and became an entrepreneur and works for himself. His relationship with his family is on the rocks, I doubt he will reconcile with them after what they did.
False accusations destroy men's lives, just the accusation alone. That's why I will side with men until rock solid evidence proves the to the contrary.

Re: Innocent NFL Prospect Did 5 years in Prison For A False Rape And Kidnapping Accusation
Yes, and again, as long as women (and men too) readily believe a woman's allegation against a man (therefore judging him and generalizing him -- the same things they expect us not to do towards them) I will assume, just as much, that women (and manginas) are guilty and "like that" too, no matter how much of a good face (act) they put on.
In order to convince me they'll have to be convincing. Just as they assume the worst of us when some woman accuses us I will assume the worst of them because it is evil to assume a man is guilty, brainwashing or not. I know, "but isn't it evil for you to do the same thing to women?". It is reactionary. As long as they assume I'm guilty of rape based on a woman's word that means they'd side with a lying woman over an innocent man. This means that I would be judging them based on the fact that they assume men are guilty not based on an assumption (as they judge men based off of).
However, I will assume a woman is bad until proven otherwise the very same way women assume we are guilty until proven otherwise or even when proven otherwise. Any woman who assumes guilt of an innocent man is bad. As for men, since probably 50-80% of men are manginas I will probably do the same eventually but there are more MRA/MGTOW minded men than there are fair minded women. The ratio of women that believe false accusations against men is even higher than the ratio of men that believe false accusations of men even though those men are just as damaging.
I despise manginas just the same but I won't assume a man is a mangina until I am given reason to.Last edited by Popadibs; 26th-May-2012 at 06:11 PM.

Re: Man freed after being exonerated of rape
Note how forgiving this man, who was wronged by a woman and the system, is and compare this to how vindictive a lot of women, who weren't wronged by men and the system, are. Note that and figure out for yourself why many women aren't likable. Why subject oneself to a relationship with those women?

Re: Man freed after being exonerated of rape
Just curious,do you think he could bring a civil suit against her for her false accusations? Would it be something the courts even consider,or would they throw it out? If he could sue,and decided to do so,I'd say he should sue for, say, 1.5 million.
-
Re: Man freed after being exonerated of rape
I understand that he's forgiving and wants to go after his goals but this man needs to see the bigger picture.
If he ever becomes a superstar and a woman falsely accuses him again, since he handled it this way the first time, and she gets away with it, she's try to get him prosecuted to the full extent of the law even though she'd know he was innocent.
Just like the 1983-1984 Boston Celtics stopped allowing the LA Lakers to get easy layups during the nba finals by hard fouling them when they went for layups (because they were losing when they didn't), men should allow no free passes. No easy baskets! The Celtics won the finals that year but idk, maybe men wanna be the 1985-1986 Houston Rockets. Maybe men don't wanna be champions but keep false hope of being a champion by playing by their opponent's rules. When I do this, and I know I will, it will be comparable to the lame learning to walk, the blind being enabled to see and the suffocated breathing again.
