Woman pleads guilty to ’06 rape

A 39-year-old Wheatfield woman pleaded guilty Thursday in
Niagara County Court to having sexual intercourse with an
underage male.

Kristine K. Miller agreed to the charge of third-degree rape for
one instance of abuse in July 2006, though original allegations
had included multiple other instances of abuse, said Niagara
County Assistant District Attorney Elizabeth Donatello.

“The allegations were that the abuse occurred over several
years from 2004 to 2007,” she said, adding the victim was 14 at
the start of that time frame.

However, Miller will be sentenced only for her admission to the one occurrence, which occurred in her home and involved the victim, a friend’s child.

Miller is out on bail pending sentencing.

Her attorney, Thomas Burgasser, declined to comment on the case.

Miller was originally charged in Wheatfield Town Court in May. At that time she faced charges of second-degree rape, criminal sexual act, second-degree sexual abuse and endangering the welfare of a minor.

The E-felony rape charge could result in a maximum of four years in state prison. Sentencing is scheduled Jan. 20 before Judge Matthew Murphy.
