Name suppression has been refused for a 21-year-old woman whose false rape complaint forced part of central Christchurch to be shut down.





Alyshia Shannyn Clyne, a mother of two, was ordered to do 75 hours of community work by Christchurch District Court Judge Brian Callaghan, the Christchurch Court News website reported today.
She had pleaded guilty yesterday to a charge of making a false complaint to a woman police officer that she had been raped after a night drinking in the city with friends.
Clyne said she had been dragged through Strand Lane into Cathedral Square and raped by an unknown man early on November 6.
But video surveillance footage, and a statement from the friend she was with, showed the attack could not have happened.
While the complaint was investigated, part of the central city was cordoned off, disrupting businesses and pedestrian traffic. Ten police officers worked on the investigation.
Judge Callaghan said it had not been a minor complaint and had attracted very comprehensive police reaction.
She was a first offender but the seriousness of the offence needed an appropriate response and a firm reaction.
He refused final suppression of her name, sentenced her to 75 hours of community work, but gave leave for some of the hours to be converted to training.

Well done that Judge. On the Day of Men's Retribution, he will get a single FMJ to the heart instead of the legs first. Mark his report as 'tries occasionally'.

75 hours. Thank God some poor sap didn't get his innocent arse thrown in the slammer. It could have been 60. And yet all those coppers wasting thousands of taxpayers NZ dollars and a mile of 'Police. Do not Cross' tape. How about having her scrub out the friggin' cells for a year and paying off the cost with hard labour.

That woman was doomed from the start. What nig-nogs of parent (s) she must have had. You can spot these false accusers almost just by their names. What sort of halfwit would name a child "Alyshia Shannyn"? What sort of provenance do these agglomerations of phonetics have? I can imagine such creative cretins, these verbal finger-painters saying "Wewl, loyke, its difrun', innit, yano".

My thoughts, as well, Percy. Great that she's not being granted anonymity, but 75 hours community service? The more slaps on the wrist we see for unconscionable behavior, the more we're going to see it and the longer it will continue. I imagine it would take only a few instances of women having to serve the same sentences they were willing to allow those they falsely accused to serve before false rape allegations would become almost nonexistant.

Every time I see that a rape-report fabricator has gotten "community service", I find myself extremely curious about what that community service entails. Will the tart be picking up litter? Bathing cats and dogs in an animal shelter? Lecturing boys and girls about how rape is evil? I usually surmise that the hoaxer will be assigned to a woman's shelter!

The only community service that would be acceptable (in addition to the standard SEVEN years in jail for rape) would be to spend the 75 hours at a busy intersection wearing sandwich boards that read on both sides "I AM A LIAR. I FALSELY ACCUSED A MAN OF RAPE. DO NOT TRUST ME."

Also, I would love to know what training the menace is going to undergo!

It's grossly disproportionate to the crime. You can try to murder someone and it doesn't work out...hire a hit man or something who bails...and you go to jail. Some people are in jail for 15 years for attempted murder...longer than many murderers get. In the US in some areas murder entails about a 7 year period behind bars. Yet the guy who a woman may have attempted to murder might have experienced nothing to that point since a hit man got foiled. But false rape accusations do in fact harm people. In my town it came out that there had been domestic violence in my marriage so some folks to this day many years later think I "did something". I was on the receiving end and had to be operated on. Besides being unable to get a restraining order, getting thrown out of my own house after additional assaults, being told NOT to call the Police as they would arrest me instead and so forth there are still people angry at me for harming a woman...which I never did. People hear about the rape accusation, names are named and many never hear about the later false rape investigation and exoneration of the guy who could have spent months in jail, have lost his job, have lost relationships with people, lost child visitation, etc. In my case the town never heard about me prevailing in Civil Court on the assaults when Family Court would not help me.

This false rape accuser should pay a much more severe crime than 75 hours of community service. As some have noted this can entail conflicts of interest. For example she could go to schools and encourage girls to contact the authorities if they are raped, while acting like all men are violent. Then she could talk about domestic violence and shelters and so forth.

Thanks. I used to think we had freedom in America, in the USA. Maybe at one time that was true. But go to family court if your exe is agressive and can stomach lying and you'll change your mind. Or have a female cry rape and you'll be collected and jailed unless she recants or the case falls apart for other reasons.

I think we have gotten too far away from basic principles. For example in the US we don't talk about strengthening families or marriage much...rather we spend lots of time, money, and energy redefining it to include just about anything.

If you read the US laws...our civil rights, our basic freedoms, the promise if you will...it can sound pretty good.

* You have the right to quietly enjoy privacy and comfort in your home. So things like search warrants are needed. Unless you are in family court and child protection gets called on false allegations.

* You are supposed to be considered "Innocent Until Proven Guilty". Not in Family Court, or if accused of rape, or if someone sues your company for sexual harassment naming you, etc. Then you are "guilty" immediately. And may stay "guilty" even if later exonerated.

* Equal Protection Under The Law...it is supposed to be the same for everyone but it just isn't even close at times.

* Right to Confront your accuser: False abuse claims done "ex parte" are common with only one person, the accuser present. These often lead to temporary orders which are rubber stamped semipermanent. There is no cost to a false allegation.

* Perjury - this is lying under oath. False allegations are common and then the accused is in for an ordeal. If the story unravels, most of the time the accuser can just make another wild claim later on again with no penalty. If the claim fails, there is no cost...if it succeeds then she can win big. The only restraint? Her conscience. What about public opinion? I read about rape stories in the paper all the time. Many of those fall apart later on statistically. But this seldom makes the paper.

There are many other example of so called rights not actually existing.

If these well thought out limits to state power were actually in effect, so many fewer outrages would occur.

Oh yeah...when I go food shopping and round a turn with my kart / trolley...there are still some people who will say nothing or glare at me and then turn around to shop elsewhere in the store. I can say "hi" and there will not be a reply. They think I attacked my exe-wife. These are folks I know in town, see in church or my son's school, parents of friends of his and so forth:

Little do they know that:

* She attacked me, and I never hit back

* I had to be operated on, and my arm will never fully recover and hurts daily.

* That my just operated on arm then got attacked by my exe, as it was a "weak point"

* That I got thrown out of my own house, yet I was the victim.

* That my son ran into many similar matters with his Mom until he kid of caved in and stopped expressing himself and just does what he says. Ye t I had been the main parent and the child had to go through a huge upheaval, changing to a disinterested never involved before Mom.

* That my exe spent years trying to alienate my son against me, and finally succeeded. I consider that a form a child abuse. I just want to see and help raise my son. My schedule is 4 days a month. Which has not occurred at all in over 17 months. In fact it has not occured without obstruction ever and rarely would I get all of a given month's time and nothing around the holidays. What about the rights of the grandparents, aunts and uncles and cousins to see the child?

It goes on and on.
