Innocent man accused of sex offence severely disabled after jail assult

WINNIPEG — The mother of a former inmate of Manitoba's Headingley jail is suing the provincial government, claiming it failed to protect her son from a vicious jailhouse attack that left him with permanent brain damage.
Nicholas Tanner was arrested in August 2008 on a sexual assault allegation and ordered held in custody at the provincial facility while awaiting trial. The charge has since been dropped.
His mother, Pamela Cook, filed documents this week claiming Tanner should have been kept in protective custody with other alleged sex offenders but was instead placed in general population. She says this was a violation of provincial policy.
Cook claims another Headingley inmate attacked Tanner on April 6, 2009, repeatedly punching and kicking him in the head until he was unconscious and causing "massive neurological injury."
She says several guards were slow to respond and her son suffered bleeding on the brain. She says he remains in hospital with no ability to speak or comprehend what is going on around him.
"He was rendered totally and completely disabled, physically and mentally, and will remain so for the rest of his life, thereby necessitating full-time and ongoing permanent care," the statement of claim says.
Cook claims the inmate who attacked her son has a "propensity for assault and battery, in particular of his animosity toward sexual offenders and, in particular, towards Tanner."
Cook has named Headingley Jail, former provincial Justice Minister Dave Chomiak, current Justice Minister Andrew Swan, the superintendent of Headingley and three unidentified guards in her lawsuit, which seeks unspecified financial damages.
She also claims Jason Boubard was the inmate who attacked her son and seeks damages against him. Court records show Boubard is facing an aggravated assault charge stemming from the same date Tanner was attacked. He remains before the courts and is presumed innocent.
Court records also show the Crown entered a stay-of-proceedings against Tanner in August — likely due to his grave medical condition and inability to attend court.
All of the parties named in the lawsuit have 30 days to file a statement of defence. The provincial government has a policy not to comment on any matters that are before the courts.

I dont think any inmates should get punished
its the gaurds who tell the convicts who the kiddie diddlers are

Yes, I agree. The inmates, though acting outside legal paramaters, are doing what people would do anyway - their bit of vigilantism. Those who put the man in the position where this terrible act was enabled are those most deserving of punishment.. the false accuser (was it a false accuser, a case of mistaken identity or misdeeds on those giving evidence, jury, ect?)

chances are the CO's are the ones who told the inmates what the guy was charged with
and by telling them, they are giving carte blanche to them to do what they do

Nice to see you endorse and promote violence against people who are assumed innocent until proven guilty. You must be a real hard dude!
What do you endorse & promote for women who accused of making false allegations? What about those who make false allegations, and result in innocent men being beaten until they're a vegetable - should we stamp on these women's heads until they too are vegetables?

And feminists keep telling us that men accused of rape (falsely or otherwise) do NOT face any problems...

This is why accused people should retain their anonymity UNTIL they are proven beyond a reasonable doubt to be guilty.
