    Woman Gets 1 to 3 Years for Lying About Rape; Is Punishment Fair?

    A New York City woman, who made up a story about being raped because her friends were mad that she didn't meet up with them, sent a man to prison for four years based on her false testimony. Now Biurny Peguero Gonzalez will find out just what he went though: She's been sentenced to one to three years behind bars for perjury.
    Back in 2005, Gonzalez was hanging out with a group of girlfriends on a street when she accepted an invitation to get into William McCaffrey's car. After she returned, her pals were furious that she'd ditched them -- so she made up the rape story to gain their sympathy.
    McCaffrey was charged and convicted of rape.
    Gonzalez, a mother of two children, recanted her story last year after new DNA evidence proved she'd been lying and a priest to whom she'd confessed urged her to come clean.
    At her sentencing, the outraged prosecutor asked that she be sent away for two to six years "so that there's a chance that she will serve what he served."
    So what do you think -- is her punishment fair?
    At least she is going to spend time behind bars. Though, the penalty should have been stiffer.

    There needs to be both an increase and consistency in such sentencing, otherwise the message doesn't reach the average woman who might toy with such an idea considering the leniency applied if she's revealed.

    I believe the punishments on perjury (false rape accusations) should be as hard as a man would have been punished. Although this would not be likely to happen anytime soon, it MUST become more consistent to throw women who make up these lies behind jail instead of just an occasional odd one out. It is simply not going to spread the message that it is not accepted if false accusers are not punished consistently.

    The innocent man spent four years in prison, therefore, she should spend at least that long in prison.

    It's difficult to conceptualize such innocent suffering unless your experience comes any where near to this understanding.

    It's the reason that infuriates me, I, along with any other man, can have a finger pointed at them and accused of being a rapist, just so that a woman doesn't have hurt feelings, or doesn't have a falling out with her friends, and the law seems more than eager to help these horrid women get what they want.

    Some here are asking if her sentence is fair, I say fuck the sentence, take her fuckin' head off, get a woman to chase her down and throw bleach in her fuckin' eyes, get a gang of women who care about you to gang up on her and beat the living shit out of her, and why get women to do it? Well who the fuck is going to punish them?

    I totally agree.


    If I had been sent to prison when I still had a mortgage on my house, then I would of lost my house, likewise, if I was paying for my car on a finance deal then I would of lost my car.


    There is also the suffering of being treat as a rapist when one is innocent, would friends, family members and neighbours turn against me ? After all no woman would lie about such an horrendous crime.


    How would I be treat in prison ?


    I have no doubt that I have not summed up how bad it would be !!!

    Personally most citizens cannot be trusted with free thought, they are a deliberating negative currency that ensures a blinkered vote dependant on fluctuating thinking. This is good, lets get women thinking about what they're actually voting for?

    Not even serving the four years she took from her victim is enough. She should have anything of worth that she owns seized and liquidated to pay towards the victims compensation also any earnings or future inheritance she is likely to have should be garnished, maybe the court officials, judge, persecutors who ever was involved in a wrongful conviction should also be penalised in some way too ...... she should also be forced to live for ten years with a tracking device and some kind of visible warning so that others know what a risk she is.


    False accusations of rape and other serious crimes are too often minimised as wasting police time or some such minor crime, when in fact it is far far worse, the false imprisonment is bad enough then there is the damage to reputation, career, family and friends the treatment one can expect inside as a convicted rapist, any future employment prospects .... having someone falsely convicted of rape is as close to murder as you can get without actually killing them.

    That said I know a good fellow whose whole life was ruined by unsubstantiated nastiness directed at him. I'll always support him to this day.

    A young mother who falsely cried rape, sending an innocent man to prison for nearly four years, will experience firsthand what he suffered -- she'll spend one to three years behind bars for perjury.

    "I wish her the best of luck," said William McCaffrey last night of Biurny Peguero Gonzalez.

    "Jail isn't easy."

    McCaffrey, 33, of The Bronx, was locked up after Gonzalez accused him of raping her at knifepoint on a Bronx street back in 2005.

    It was a lie she repeated to doctors, cops, prosecutors, a grand jury and the jury that convicted McCaffrey.

    "What happened in this case is one of the worst things that can possibly happen in our criminal-justice system," Manhattan Supreme Court Justice Charles Solomon said as he pronounced sentence.

    McCaffrey said he has some sympathy for Gonzalez and hopes she "doesn't go through what I went though.

    "I was an accused rapist in prison," he said, adding that in prison, "rape is the worst crime possible."

    All is clearly not forgiven.

    A person who would "lie and paint somebody as a rapist is worse than a real rapist or a real murderer," McCaffrey said

    He also blamed "the arresting officers, the prosecution." Everyone, he said, "wanted to believe the lie, the ADA [assistant district attorney] first and foremost."

    Judge Solomon said, "It's hard to imagine why anyone could have done this."

    It turned out Gonzalez robbed McCaffrey of four years of his life for the most trivial of reasons.

    She'd been hanging out with a group of girlfriends when she accepted an invitation to get into his car.

    After she returned, her pals were furious that she'd ditched them -- so she made up the rape story to gain their sympathy.

    She will be eligible for parole in a year -- after serving a one-quarter of the time her victim was imprisoned.

    Gonzalez was taken away after making a tearful apology to McCaffrey, who was not in court.

    She also begged for mercy on behalf of her two sons, ages 3 months and 7 years.

    "To Mr. McCaffrey, I am aware that nothing I do or say to him can bring back the years he spent in jail," she said. "I want him to know I will carry this guilt for the rest of my life."

    Gonzalez, 27, had recanted her story last year after new DNA evidence proved she'd been lying and a priest to whom she'd confessed urged her to come clean.

    Gonzalez had repeatedly insisted she was "110 percent" sure McCaffrey had raped her after they met in Inwood, in upper Manhattan, and she drunkenly accepted a ride.

    "It was a complete and utter lie," Assistant DA Evan Krutoy told Judge Solomon.

    The outraged prosecutor asked that she be sentenced to two to six years "so that there's a chance that she will serve what he served."

    Krutoy conceded that Gonzalez -- with a previously clean record -- looked like a good candidate for probation.

    But ultimately, she needed to serve time, Krutoy said, "because of the extent of harm that she caused . . . She came into court and she lied."

    Her lie -- blurted out as her girlfriends were slapping her around -- took on a life of its own, fueled in part by McCaffrey's long rap sheet of violent arrests.

    Gonzalez could have pulled the plug on the prosecution at any time, but instead she watched McCaffrey get sent up the river for a rape he never committed.

    Her lawyer, Paul Callan, conceded of the perjury, "It is not defensible."

    He insisted that Gonzalez suffered horrible abandonment and sexual abuse as a young teen, and has now had "a spiritual awakening."

    "She is not the same person as the one who committed this crime at age 22," Callan said.

    The lawyer said that at their first meeting, she'd told him, "I don't care what happens to me. You have to get Mr. McCaffrey out of jail."
