Man Sues Over Women Using Men's Restrooms and Gets Fined for Frivolous Lawsuit
Lawsuits alleging pain and suffering don’t always involve physical injury. Sometimes, the pain is to the psyche - with these civil filings, the keywords are usually “emotional trauma” or “distress.” San Diego lawyer Robert Glaser claimed to have suffered “embarrassment and emotional distress” when he discovered women were using the men’s bathroom at a 1995 Elton John-Billy Joel concert, at what was then called Jack Murphy (now Qualcomm) Stadium.

The women had apparently resorted to the (surely less desirable) men’s facilities because of long lines outside women’s restrooms. In March 1995, Glaser filed a $5.4 million lawsuit against the city of San Diego, claiming that, upon discovering that women were using the men’s bathroom, sometimes squatting over the urinal troughs, he was ''angered, upset, embarrassed, distraught and (feeling) violated.’” He said his “civil rights to privacy” were violated by having to urinate ''in front of women in the men's bathroom.''
Glaser said he checked “six or seven” other men’s rooms, finding women present in all of them, and that he “had to hold it in for four hours” because he was unwilling to urinate with women present. He also named the beer vendor in his suit, claiming their irresistible product, prolific presence and superlative salesmanship had contributed to his eventual discomfort.
The 9th U.S. Circuit Court of Appeals ruled that Glaser’s claim was unreasonable, ordering him to pay $2,000 in fines to the city for filing a frivolous lawsuit. He and his lawyer were also required to pay $2,000 to the concessions company Glaser had blamed for selling him the beer. Glaser took his appeal of this ruling appeal all the way to the California Supreme Court which, in December 1998, denied Glaser's appeal without comment. Glaser did not respond to emailed requests to be interviewed for this piece.

Imagine a man went into a ladies restroom? This "pervert" surely would get punished.

1. Yes, a double standard exists. Men would have been reviled and punished for invading a women's restroom. That's irritating.

2. I think that the man who brought this lawsuit deserves the fine that he got. What a total dumbass. It's an Elton John concert -- there's probably all kinds of licentiousness going on, just like most any rock concert. There's probably people getting drunk, getting high, getting a little naked too. This prude has the temerity to put himself in that environment, then claim that he felt violated. And the city is to blame and must compensate him with millions of dollars. My contempt for litigious people like him knows no bounds.

I think he was trying to make a point that got out of hand. Seriously, if a guy had used the chick's bathroom he'd probably be arrested. He's probably a lot like us; just sick of the double standard.

Great point. I would be just as upset as Mr. Glaser was. Women do not belong in men's bathrooms or locker rooms no matter what the circumstances. It's not men's fault women take so long and there are long lines in "ladies" rooms.

The lineup for the ladies' room is always twice as long. These chicks probably didn't want to wait, and just waltzed into the men's room expecting to do their business without any hassle.

Why can't we men be afforded basic human privacy? Women claim the "right to privacy" when it comes to abortion, yet they cannot even allow us men to use the bathroom without violating our privacy rights!! Typical hypocrisy.

I remember once when I was in Mexico at a major event, the men's room was "commandeered" and made into a unisex bathroom with cops guarding it. So everyone (men, women, and children) had to wait in line for a few stalls while the urinal trough remained unused. How ridiculous. If women can't learn to speed up the process, why should we men have to pay the price? (BTW, in Mexico, men get searched with metal-detector wands prior to entering clubs, but women do NOT.)
