Virginia mulls discrimination against divorced parents: child support college mandate
Article here. Excerpt:
'Married parents don't have any legal obligation to pay for their adult children's college education or living expenses. But a bill just introduced in Virginia's legislature would require divorced parents to pay for such expenses.
HB 146 would extend child support beyond age 18 to age 23 when the "child" is attending college. Right now, child support in Virginia usually ends soon after the child reaches the age of majority.
The Pennsylvania Supreme Court struck down a similar provision providing for post-majority support as a violation of the Constitution's Equal Protection Clause. It reasoned that since married parents do not have to support their adult children, it was discriminatory to force divorced parents to do so. See Curtis v. Kline, 666 A.2d 265 (Pa. 1995). (Courts have apparently split over the constitutionality of such requirements).'

Re: Virginia mulls discrimination against divorced parents: child support college man
Several US states have found child support (with or without college) unConstitutional due to the fact that married parents are not forced to spend a certain amount of money on their children....so then...divorced parents should not be forced to either.
Of course, those rulings changed nothing since there is so much money to be made/saved by the state in collecting unConstitutional child alimony.
In case you were wondering:
The state makes alot of money collecting child alimony via the Federal Government who pays them a percentage based on the amount collected. As you can guess, this creates a conflict of interest and helps to explain why state courts set amounts so high.
As for the saving part, yeah, they save alot because those women who kick the fathers to the curbs would be leeching more off of the government than they already do without child alimony.
Just goes to show you that money > law."If Blizzard expects you to be always online to play their game. Then Blizzard need to always be online whenever you want to play it."- Unknown internet poster

I guess the next thing is to have the non-custodial parent pay child support for the grandkids.

How disgusting... so now they can keep leaching child support from a guy (or a woman in some rare cases) for five more years.

Re: Virginia mulls discrimination against divorced parents: child support college man
I have a friend that was paying child support to his ex wife and her boyfriend was using it to support his drug habit. He realized this when he went to pick up his kids and their clothes were getting rattier and rattier. He also asked the kids about it, as they were just getting to the age where they become cognizant about such things, and they said that mommy wasn't taking care of them like she used to before the new boyfriend came along.
He got another custody hearing but he still didn't get his kids. Can you imagine?Do not ever suppose that a small group of people can never change the world. INDEED it is the only thing that ever has.

Women get custody by default and that is a simple business decision by the state.
- Men are less likely to pursue child alimony than women are (this means less $$$ for the state)
- The state is less likely to use harsh methods to get women to pay up as society wouldn't allow it (and that means less $$$ for the state)
- Women are less likely to pay no matter the enforcement methods (so that means less $$$ for the state)
It is clear why women get custody by default and keep custody in most cases no matter how horrible they are as parents."If Blizzard expects you to be always online to play their game. Then Blizzard need to always be online whenever you want to play it."- Unknown internet poster
