A Montreal father waiting to reunite with his missing daughter who was found last month in Vancouver living with her mother is facing an uphill legal battle to bring her home.
The man – who cannot be named because his daughter is in protective custody in British Columbia – is still waiting to see his daughter, who went missing from Montreal two years ago.
Police found the 10-year-old girl in B.C. earlier this spring when she called authorities from a pay phone after running away from her mother's home.
She had been living with her mother in Vancouver, who took her there without the father's knowledge despite not having custody.
The father travelled to B.C. in late April with the hope of a reunion with his daughter. But he returned alone, having only spoken to her by phone, because of a custody dispute with her mother.
A Quebec court has granted him full custody of the girl, but the order is only recognized in that province for now.
He said his visit to Vancouver was marked by one roadblock after another.
"We get there, [the mother] got a lawyer, and before we even get started, they say they're going to try to tie it up for as long as they can," he told CBC.
The mother is contesting the Quebec custody order in B.C. Superior Court. "[She's] saying [she] wasn’t properly notified," the father said.
Quebec has already issued a warrant for the woman's arrest on contempt of court charges for failing to comply with the custody order.
Montreal police are working on extending that warrant nationally in order to be able to enforce it in British Columbia, said police spokesman Ian Lafrenière.
"The good news for us is that the kid is safe, but on the other hand, there is a legal issue at this moment," he said.
The girl will remain in protective custody until her parents sort out their dispute.
Her father said he's scared it will be hard to reconcile with her after all this time, especially after speaking with her on the phone.
"We didn't talk much; it was just hello," he said. "I went there to rekindle a relationship. It looks now like I have a court battle in B.C."
He believes she's been brainwashed, he said. "Clear and simple. Because even when she was small, she used to say, 'Mommy says bad things about you; when I'm with mommy, I say bad things about you."
CBC tried several times to contact the mother's lawyer, but messages were not returned.

State Jurisdictons are a delicious source of money for salivating rent seeking scum lawyers. 'Federations' of States are an invention of Lawyers and politicians who care nothing of 'Rights' but keep 'Power' anally.

This woman should be arrested for kidnapping. What the f*ck are the police playing at. There would be an arrest damned fast if it was a Father who had ran off with the child.

Every time it is the same rigmarole. Father gets the run around; mother gets the free pass; child get poisoned.

wow-can u believe this comment? must be a spoof

I don't think the father deserves custody.
Most fathers just want custody so they can save on child support payments by not having to make any.
He'll just keep the kid at home in second hand clothes and bargin bin discounts. That way they can spend more money on booze and on wowing the new stepmother. Skimp on dental care so that when the kid is in their 30's the kid will have to pay massive amounts of money to keep from grinding away their teeth due to the physical and emotional abuse they had to endure from the stepmother.

    WTF?!

"Civilization can only revive when there shall come into being in a number of individuals a new tone of mind, independent of the prevalent one among the crowds, and in opposition to it- a tone of mind which will gradually win influence over the collective one, and in the end determine its character. Only an ethical movement can rescue us from barbarism, and the ethical comes into existence only in individuals."

"Until he extends his circle of compassion to include all living things, man will not himself find peace."

Fed on a constsnt stream of misandry from our media, this is just typical of the attitudes that permeate out society and reach deep into the family courts.

This is what the 'roadblocks' are made from.

Faludi maintain, men are not portrayed as heroes in the press, but more often as pedophiles or deadbeat dads. The truth is suppressed by journalists and their slant "is wrong both truthfully and morally." The Australian's campaign against domestic violence was a horror show of anti-male propaganda.

    4. Giving a Dog a Bad Name, Part II. Message: Women have now adopted the habit of disrespecting men and echoing the message of feminists and the media. What can we do about it? Well, most of us are doers rather than talkers and when we don't defend ourselves we lose out. Are women willing to forfeit the paternal feeling that most men have for them in the name of equality? More and more men refuse to see themselves as the providers and protectors of women.

Breaking News-Mother of 'missing' 10-year-old girl arrested in B.C- Child had been declared missing by father two years ago

Mother of ‘missing' 10-year-old girl arrested in B.C.
Girl called 911 to say she had been abused; police learn she had been declared missing by father two years ago

    http://www.theglobeandmail.com/news/national/british-columbia/mother-of-missing-10-year-old-girl-arrested-in-bc/article1154356/

The mother at the centre of a cross-country custody dispute that gained considerable attention when the child in the matter ran away from her Vancouver home and called 911 has been arrested.

Araceli Bravo was detained by Vancouver Police at an undisclosed location in the city. Montreal police are expected to arrive Wednesday to escort her back to Quebec.

Police in B.C. were acting on a Canada-wide warrant for abduction in contravention of a custody order, said Constable Jana McGuinness, a spokeswoman for Vancouver Police.

The arrest was “uneventful,” Constable McGuinness said, noting that police in Vancouver acted on information from their counterparts in Montreal. She declined to be more specific.

Constable Yannick Ouimet of the Montreal force said he could not comment on the information supplied to B.C. police. “We never reveal our tactics,” he said Tuesday, noting that he had not even heard about the arrest of Ms. Bravo until told about it by a reporter.

Ashley Gonis, 10, turned up at a Vancouver SkyTrain station last month and called 911 suggesting that she was being abused at home.
Police dismissed that suggestion. Ashley's Montreal-based father, Frank Gonis, had been looking for her for two years after Ms. Bravo allegedly kidnapped her in a custody dispute. Although Montreal police had issued an arrest warrant for Ms. Bravo, it was enforceable only in Quebec until recently.

Mr. Gonis, a home renovator, said Tuesday that his focus now is on his daughter.

“Ashley is coming home. That's all that's important,” he said in an interview. He said he expected his daughter, now under government supervision in B.C., would be placed in foster care when she is returned to Quebec while decisions are made about how to proceed.
“I know she's mixed up,” he said.

Mr. Gonis travelled to B.C. after his daughter turned up, but the custody dispute with Ms. Bravo continued in the courts and he was unable to see Ashley.

“It didn't go well,” he said.

He noted that authorities lost track of his former partner after the hearing, until Tuesday.

Mr. Gonis said he never gave up due to concern about his daughter.

“I knew I could offer her a lot,” he said.

As for Ms. Bravo, he added, “she'll have to go before the courts and we'll see what happens.”

Thumbs up Re: Montreal dad in custody fight after missing daughter found in B.C.

The only place I have noticed to have a pragmatic views on Family Law is Pakistan remember the Scottish dad who took his child there as that is what the child wanted and the authorities there upheld their wish! "The best interest of the child truely being served!"
