Woman who punched policeman spared jail

From Daily Mail: Woman who punched policeman spared jail because she gave him chocolates to say sorry

    Quote:
A young woman who punched a policeman was spared jail because she had bought him a box of chocolates to apologise.

Kylie Fisk, 20, lashed out as officers tried to break up a brawl she was involved in outside her home. She screamed abuse, kicked a police car and punched Sergeant Alistair Livingstone in the mouth, leaving him with five deep scratch marks.

But she was shown mercy by District Judge David Copper after he was told she bought the officer a £3.10 box of Nestle chocolates in an attempt to say sorry.

The judge, sitting at South East Suffolk Magistrates' Court, told Fisk: 'That is a very sweet gesture. I have never heard of that happening before.

'I have to consider compensation. You bought the police officer a box of chocolates, that is nice. You just go and give him that.'

But he added: 'You have committed a very serious offence. It must never happen again or you will go to prison.'

The court was told that police were called to an incident at a house in Ipswich October 18, after reports of a brawl involving Fisk, her mother, another woman, and her brother.

Robert Barnwell, prosecuting, said it was just after midnight when Fisk kicked the police car and swore and screamed at officers in a 'highly agitated state.'

He said: 'She punches a police officer in the lip with her right hand and scratches his face leaving five deep scratch marks.'

But Ian Duckworth, mitigating, said: 'She has bought the officer a box of chocolates.'

She pleaded guilty to assaulting PC Alistair Livingstone. The court heard that Fisk was a special needs student at Otley College.

After leaving the court, she dropped off her chocolates for the officer at the front desk of Ipswich police station.

Sgt Livingstone tucked into the chocolates when he returned to work on Thursday after four days leave. He said: 'I thought it was a nice gesture.'

Fisk added after the hearing: 'I had my head banged on the ground during the fight. I only got involved because I wanted to protect my mother.

'I just panicked and overreacted when the police turned up. I was in such a state that I did not really know what I was doing.

'I was taken to the police station after I was arrested and when I got home I decided to buy the chocolates to show how sorry I was.

'I was really worried that I might be sent to jail - but the judge was very nice. I just hope that the policeman enjoyed his chocolates.

'I just really regret my behaviour on that night and I am very ashamed about it. I have never been in trouble before.'

Fisk's mother Vicky Combstock, 48, said: 'She is extremely sorry. I thought the chocolates were a great idea.

'She was very worried that she might go to jail and I am delighted that the judge decided to give her the curfew order instead.'

A Suffolk Police spokeswoman refused to comment on the chocolates, saying: 'It is down to the courts to decide issues of compensation.'

Fisk was given a curfew order from 10pm to 7am for two months.
