Mom on bail for rape lie killed lover | |
A case from 2005: Quote:
A young mother from New Addington is facing jail for killing her boyfriend while she was on bail for lying about a rape.
On Monday Nicola Gale, 21, was found guilty of the manslaughter of her boyfriend Philip Whyte, 26, on September 5 last year after stabbing him during an argument.
Gale had previously been arrested in April 2004 after police suspected she had made up a story that she had been sexually assaulted. She was charged with perverting the course of justice and was released on bail.
A few months later she stabbed Mr Whyte through the heart at the couple's flat in Bygrove, New Addington, after begging him not to leave her.
The prosecution said Gale, who had suffered post-natal depression and tried to kill herself, ran to neighbours in her block of flats sobbing: "I did it."
But she later told police Mr Whyte had been attacked by a mystery intruder dressed all in black.
She changed tack again when she told an Old Bailey jury her boyfriend must have just fallen onto her knife as they rowed.
Gale, who denied murder, told jurors Mr Whyte ran on to the knife as she held it in front of her, saying: "He must have come moving quite fast towards me and that's when I think he got stabbed."
Gale was cleared of murder but found guilty of manslaughter by a unanimous verdict on Monday.
Judge Ann Goddard QC delayed sentencing until November 15 for reports.
While on remand for the killing, on October 29 last year, Gale was sentenced to nine months' imprisonment at Croydon Crown Court after admitting attempting to pervert the course of justice in relation to the false rape claim.
