    Court urged not to jail genital burner

    A court has been urged not to jail a woman who burnt her husband to death in what her lawyer has called a momentary lapse of control.

    Rajini Narayan was found guilty of manslaughter for dousing her husband, Satish, in petrol and lighting it with a candle at their home at Unley in Adelaide two years ago.

    Defence lawyer Lindy Powell said the woman should be sentenced on the basis that she had planned to burn his penis as a minor circumcision after learning he had been having an affair.


    Ms Powell said Narayan did not mean to kill the man but made a split-second mistake after he had insulted her.


    "She had indeed what might be called a loveless marriage, a marriage devoid of love and affection," she said.


    "It goes without saying that Mrs Narayan was devoted to her husband and family. She is deeply remorseful.


    "The nature of this particular case is such that one might think or ask 'What is actually to be served by imprisoning Mrs Narayan?'


    "If the fundamental purpose of punishment is protecting society then Mrs Narayan doesn't present any risk whatsoever."


    Two of their three children gave evidence for the defence about years of physical abuse family members had suffered at the hands of Mr Narayan.


    Daniel, 21, said the household had had a hostile atmosphere.


    He told of intervening on one occasion during family violence.


    "At that time my father was punching my mother and so I made him stop," he told the court.
    Daughter Jessica, 23, said her mother had rejected her pleas to leave her father because of the violence.


    "It was so hard living in such a hostile environment I ended up leaving home, she said.
    "It was the hardest decision I ever had to make. It was very easy to live with because my life was much better leaving the house."


    The prosecution is yet to make submissions on penalty but Mr Narayan's family has called for the maximum sentence.
    I can sympathise with anyone subjected to such abuse, as evidenced by the adult children, but fail to see why the woman did not get any of the myriad assistance that is so eagerly provided by the Police and 'professions'.

    She did not have to put up with it, assuming it is true.

    But listen to the drivel spouted by the lawyer....

    she had planned to burn his penis as a minor circumcision ....
    At the very least it was planned grievous bodily harm deserving of a five year sentence. To describe it as is was is an affront to all men.

    'What is actually to be served by imprisoning Mrs Narayan?'

    The misuse of an 'If..Then' syllogism.

    The purpose of punishment is THREEfold. Each is fundemental:

    It is to deter others from doing the same thing.

    It is to exact public, controlled vengance /redress for the victim.

    It is to isolate from the public for the protection of the public.

    The consequences of the criminal's action is MORE important than the motive. The motive is simply explanatory, not a justification.

    In this instance, regardless of the motive or intent, the victin DIED, for goodness sake!

    He was KILLED.

    Minor circumcision indeed.

    To equate what this woman did, or rather tried to do according to her, with a medical procedure (circumcision) is ridiculous. That would be like me saying I had only meant to give my wife a minor rhinoplasty after cutting off her nose.

    It goes without saying that Mrs Narayan was devoted to her husband and family.
    Why does it go without saying? And if it goes without saying, why even bring it up? I suppose it goes without saying because she's a woman and therefore only capable of love and devotion.

    The defence lawyer isn't so much the issue here- they're simply doing the job they're paid to do. The question is, how much credence will the court gives this ploy? That's the real litmus test here.

    That was a lot of petrol for a “Minor circumcision” I think that she planned to murder him.
    God kept His word and sent His Prophet in this day.

    Judgement is coming, time is fast running out !!!

    I have to agree with you here.

    The court will sympathize, as that is the nature of society when it comes to turning the assailant into the victim through prior abuse.

    As Percy stated, there is a whole world that would have helped her get out of her shit marriage, with bells and fucking whistles attached in the form of alimony and child support.

    She should be punished for killing a man. Not turned to a "Joan of Ark" for vengeance served.
