Florida father denied parental rights, DNA Test, Offered 100K to walk away from child | | Quote: FLORIDA FATHER DENIED PARENTAL RIGHTS, DNA PATERNITY TEST AND OFFERED 100K TO WALK AWAY FROM CHILD BY GRANDPARENTS
COURTS HAVE THE ABILITY TO DETERMINE FATHERHOOD OR ALLOW THE AGONY OF GUESSING TO END Coral Springs, FL 6/13/2008 04:54 PM GMT (TransWorldNews)
In a time where most unmarried fathers run and hide from the responsibilities associated with their pregnant girlfriends and their children born out of wedlock, Robert Fedderwitz is pleading for his paternal rights and is willing to voluntarily accept the burden. The mother on the other hand, is looking to stonewall him and deny him his right to parent his son.
Fedderwitz already missed the first ten months of his son’s life and he is fighting with all of his heart and soul to not lose him forever.
After being told by fiancée Jenna Pelusio that she was pregnant with their child, Fedderwitz thought it was the beginning of the family life he had always dreamed of having. Instead of passing out cigars at the time of the baby’s birth, Fedderwitz served Pelusio with a Paternity action to stake his claim in his child’s life. He is now fighting endless court battles, initially, just to have a simple paternity test taken by all involved. He is also facing the risk of losing all parental rights to his son forever.
According to Fedderwitz, his fiancé mysteriously left their Florida home in her final month of pregnancy, against medical advice, after urging from her over-controlling parents. Pelusio is now denying that the child that they talked about having and then conceived is not his. Fedderwitz claims that she told him that grandparents Jack and Deborah Pelusio of Long Branch, NJ went so far as to offer Fedderwitz $100,000.00 in cash to walk away from their grandson and surrender his parental rights and sign an Affidavit of Non-Paternity.
Monmouth County residents should pay particular attention to this litigation that is pending before Judge Teresa Coyle in the Chancery Division, Family Part, with a case number of FD-13-001415-08A. All residents, especially those that live on Cooper Avenue, will learn all about their neighbor’s scheme to conspire to commit paternity fraud and learn how a rich family and a morally bankrupt lawyer can seek to pretend that a bond between a father and his child does not exist.
Fedderwitz appeared in Court, by phone, on April 28, 2008, and asked for a DNA test. The Judge said that she would take it under advisement and it was tabled until the next hearing. The father was next set to appear in the same Court on Monday, June 9, 2008 to take the DNA test, which was going to be a no-brainer, to finally prove his fatherhood.
It never happened. Ms. Pelusio's lawyer, Michael K.W. Nolan sought an eleventh hour continuance, which was granted. The hearing is now continued for a return date of July 2, 2008.
Scott Alan Salomon, a Florida family lawyer specializing in matters dealing with Father’s Rights is the attorney for Fedderwitz and cannot understand how the Pelusios could be so cruel to deny their grandson a father. He is further miffed at how his client is forced to deal with this excruciating pain of simply settling any uncertainty with conclusive DNA results.
Salomon, as other lawyers will attest, is never one to mince words or leave any doubt as to what his point is. Salomon had a terse conversation with Nolan last Thursday that ended with Salomon telling Nolan that he needs to go back to law school and learn about the Right of Parentage.
“When I asked Mr. Nolan why he would not consent to our simple request of a DNA test, using saliva and not blood, he responded by stating that the test is too intrusive. I pointed out that all we needed was one of the baby's teething rings or pacifiers and one of the mother's empty wine glasses and we would have more evidence of DNA than necessary. It is shocking to the conscience at not only how a mother and grandparents would want this to occur, but how a member of the Bar that is sworn to fairness, honesty and integrity, would be a willing participant to this fraud.”
Salomon added, “I flat out asked him why they would not want to end this ridiculous circus and do what is best for the child. He had no answer that could ever be taken seriously in a Court of law. I look forward to setting the record straight and walking out of the Courtroom with the child one day. We are prepared to fight this at any cost to get conclusive paternal proof and justice for not only Bobby, but for his son.”
Salomon joked, “I lived in Monmouth County when I was a kid and have not been back since. I am actually looking forward to showing New Jersey that Floridians can win in their courts and that home field advantage only works for the New York Giants.”
Fedderwitz, who has since gone back to school to study law so that he can help fathers in similar situations, is taking his case to the media to expose this travesty that Salomon says Nolan is turning into a mockery. They have also consulted with public interest groups and father’s rights advocacy groups to seek guidance and build up an army to fight for his parental rights.
Fedderwitz vows, “My son deserves a father and I plan to fight for his rights and mine, I will be here for him forever. No one will ever get between my son and me, ever again, and I will fight for our relationship and give him my love until the day that my heart stops beating. ”
